On 18 March 2024, the Bill to implement the EU Digital Services Act (Law No. 50/2024) was adopted by the Romanian Parliament. The Bill aims to harmonise Romanian legislation with the requirements for digital services under the DSA. Key provisions include the designation of the National Authority for Communications Administration and Regulation (ANCOM) as the competent authority to supervise and ensure compliance with the DSA. ANCOM is designated as the single point of contact regarding the application of the DSA and the reporting of data and information to the EU Commission and as the coordinator of digital services in the other member states. Additionally, the Bill introduces a sanctioning regime applicable in case of non-compliance with the obligations established by the DSA. The Bill also creates a mechanism through which certain authorities or public institutions can issue orders to remove certain content considered illegal according to national rules.
