Introduced Enhancing National Frameworks for Overseas Restriction of Critical Exports Act (ENFORCE Act/HR 8315)

On 8 May 2024, the Enhancing National Frameworks for Overseas Restriction of Critical Exports Act (ENFORCE Act/HR 8315) was introduced in the US House of Representatives. The ENFORCE Act amends the Export Control Reform Act of 2018 to prevent foreign adversaries from exploiting US artificial intelligence (AI) and other enabling technologies. In particular, it would establish a licensing requirement for US persons to export, re-export, or in-country transfer of certain items. Furthermore, other activities that may support these items regarding the design, development, production, use, and operation are subject to the licensing requirement as well. Items covered under the ENFORCE Act include AI systems and specific emerging and foundational technologies that are essential to national security.
