On 2 May 2024, the Secretariat of Government and Digital Transformation (SGTD), under the Presidency of the Council of Ministers, opened a public consultation until 1 June on the draft Regulation of Law no. 31814 promoting the use of artificial intelligence (AI) for the economic and social development of the country. The draft regulation would require the implementation of proportional and adequate privacy protection measures throughout the lifecycle of AI systems in accordance with regulations by the National Authority for Personal Data Protection. Additionally, the draft includes transparency requirements mandating that the providers of AI systems and entities employing them inform users about the use of AI systems, operation details, decision-making parameters, responsible parties, affected parties' rights, and liability mechanisms. The draft Regulation outlines provisions regarding the responsibility for any violation of fundamental rights arising from AI use or development, holding implementers accountable under civil, administrative, or criminal liability.
