Peru: Drafted Regulation of Law no. 31814 promoting the use of AI for the economic and social development of the country including cybersecurity measures

On 15 April 2024, the Secretariat of Government and Digital Transformation (SGTD), under the Presidency of the Council of Ministers, drafted the Regulation of Law no. 31814 promoting the use of artificial intelligence (AI) for the economic and social development of the country including cybersecurity measures. The draft Regulation classifies AI systems based on risk levels and prohibits the use of AI systems that are classified as unacceptable risk. Furthermore, it would require the incorporation of security measures throughout the lifecycle of AI systems, including risk management approaches, backup systems, algorithmic audits, and the reporting of security incidents in AI-based systems. Additionally, the draft Regulation includes measures requiring the protection of privacy in AI systems and provisions regarding transparency in the operation and decision-making parameters.
