Description

Issued ruling in Commerce Commission Lawsuit against Viagogo for allegedly misleading customers about its authenticity as an official ticket seller

On 1 May 2024, the New Zealand High Court delivered a ruling against Viagogo in a public lawsuit brought by the Commerc Commission alleging misleading practices by ticket reselling company Viagogo. The court found Viagogo guilty of misleading New Zealander consumers by not clearly disclosing its nature as a ticket resale platform, making false claims about ticket guarantees, creating a false sense of urgency for ticket purchases, hiding additional fees until late in the purchase process, and falsely presenting itself as an authorised ticket seller. The ruling mandates Viagogo to correct misleading information on its website and amend its terms and conditions to allow customer disputes to be settled in New Zealand courts. Viagogo has appealed the judgment.
