Adopted EDPB Rules of Procedure for the Informal Panel of EU DPAs under the EU-US Data Privacy Framework

On 17 April 2024, the European Data Protection Board (EDPB) adopted the Rules of Procedure for the "Informal Panel of EU DPAs", as outlined in the Commission Implementing Decision C(2023) 4745 of 10 July 2023, under the EU-US Data Privacy Framework. These rules establish the panel's competence to provide binding advice on unresolved complaints regarding the handling of personal information transferred under the framework from the European Union to the United States. The panel aims to deliver advice within 60 days of receiving a complaint or referral, ensuring due process and the opportunity for both parties to present evidence. In cases of non-compliance with the panel's advice, referrals may be made to the US Department of Commerce (DoC), the Federal Trade Commission (FTC), or the Department of Transportation (DoT) for enforcement action.
