Initiated AGCOM investigative procedure into complaint submission procedures under DSA (Decision No 41/24/CONS)

On 14 February 2024, the Italian Authority for Communications Guarantees (AGCOM) adopted decision No 41/24/CONS to commence the investigative procedure for establishing a submission process of complaints in accordance with Article 53 of the Digital Services Regulation (DSA). AGCOM was designated as the coordinator of Digital Services for Italy and was tasked with overseeing the implementation and adherence to the DSA, including the handling of complaints against service providers for alleged violations. The investigative procedure aims to define the operational methods and conditions for exercising the Authority's powers under the DSA and setting up a procedure to submit complaints. The process is set to conclude within 60 days from its announcement, with provisions for possible extensions.
