Description

Introduced Protection of Children Internet Data Bill (HB 577)

On 1 March 2024, Protection of Children Internet Data (HB 577) was introduced into the Louisiana Legislature. The Bill prohibits social media companies with more than one million account holders globally from using personal data and algorithms to target advertising at users under the age of 18 located in the state. It also bans the sale of minors' personal data. The legislation permits certain exceptions, such as the display of user-generated content in chronological order and the provision of search results based on specific queries. The enforcement of these provisions will be the responsibility of the state attorney general, who may take civil action on behalf of Louisiana residents. Violations of this will result in civil fines of up to USD 10’000 per instance, with the penalties collected being directed to the state's general fund.
