Description

Announced American Privacy Rights Act including registration requirement for data brokers

On 7 April 2024, the Chairs of the House Committee on Energy and Commerce and Senate Committee on Commerce, Science and Transportation published the American Privacy Rights Act of 2024. The Act would require the Federal Trade Commission (FTC) to establish a data broker registry, which should include a "do not collect" mechanism for consumers to use. The data brokers processing the data of 5'000 or more individuals would be required to register annually. Furthermore, the data brokers would be required to maintain a public website that identifies the entity as a data broker and include a tool for individuals to exercise their opt-out rights.
