Italy: Issued AGCOM decision on Google's application for an exemption from the obligation to invest in European works

Description

Issued AGCOM decision on Google's application for an exemption from the obligation to invest in European works

On 24 January 2024, the Italian Communications Regulatory Authority (AGCOM) approved Google's request for an exemption from investing in European works for 2023. The exemption applies to Google's on-demand audiovisual services, including Google Play Movies and TV and YouTube Movies and Shows in Italy. The decision was based on Google's application filed on 2 October 2023, seeking relief from investment obligations in European works for services aimed at Italian consumers. AGCOM's approval complies with EU Directive 2018/1808 and national laws. The exemption was granted due to Google's revenue in Italy for 2022 falling below the EUR 5 million threshold. AGCOM noted that the exemption is effective from 1 January to 31 December 2023, and an appeal can be made to the Regional Administrative Court of Lazio within 60 days.
