Announced European Commission investigation into Apple's fee structure compliance with Digital Markets Act

On 25 March 2024, the European Commission announced an investigation into Apple’s fee structure compliance with the Digital Markets Act (DMA). The investigation concerns Article 6(4) of the DMA, which obliges gatekeepers to ensure the installation and effective use of software applications by third parties on their operating systems. The article does not prevent gatekeepers from implementing measures concerning third-party software apps in order to ensure the integrity of the hardware or the security of end-users. In particular, the investigation will examine the fee structure and other terms and conditions that Apple has implemented in connection with alternative app stores and web distribution of apps. The Commission aims to conclude the investigation within 12 months.
