On 16 June 2023, the eSafety Commissioner adopted the App Distribution Services Online Safety Code under the Online Safety Act 2021. The Code outlines a set of regulations and compliance measures for app distribution service providers, with a focus on ensuring the safety of the online environment for users, particularly concerning Class 1A and Class 1B material. The scope of the Code covers service providers that enable Australian users to download third-party applications and sets out exemptions, such as services that provide first-party applications or those for internal use by companies or organisations. It outlines minimum and optional compliance measures, including engaging with third-party app providers, maintaining a trust and safety function, providing age and/or content ratings, and participating in industry forums. In addition, app distribution service providers are required to report app removals to eSafety and submit annual reports detailing their compliance efforts and the effectiveness of the measures implemented.
