Issued Trade Competition Commission's decision on unfair service fee increase by e-commerce operators Company G Co and Company H Co

On 28 February 2024, the Trade Competition Commission of Thailand issued a decision on a case involving electronic commerce platform operators Company G Co and Company H Co. The companies were accused of unfairly raising service fees. The complainants operate platforms where products are sold by various merchants, including the platform called Shop N. The Commission concluded that the increase in the fee rate for sales, which was announced in advance and set at a level close to or lower than that of other market operators, cannot be considered as setting an unfairly high fee rate according to Section 50 (1) of the Trade Competition Act (B.E. 2560) and the Trade Competition Commission on the Guidelines for the Consideration of Prohibited Acts by Business Operators with Market Power (B.E. 2561).
