On 4 March 2024, House Bill 707 was adopted by the Virginia Senate. The Bill proposes amendments to the Virginia Consumer Data Protection Act (CDPA) with a focus on the protection of children's data. The Bill proposes specific requirements for the processing of children's data, the use of geolocation data, and the conducting of Data Protection Assessments (DPAs). The proposed amendments prohibit the processing of children's personal data for targeted advertising, the sale of such personal data, or profiling for purposes other than the initially disclosed purpose and any purpose without the prior consent of the parent or legal guardian. Further, the amendments would restrict the collection of children's geolocation data. Finally, controllers who market products or services to children would be required to conduct data protection assessments.
