Issued advisory concerning Due Diligence by Intermediaries under the Information Technology Act and Rules including authorisation requirements

On 1 March 2024, the Ministry of Electronics and Information Technology of India announced additional measures for the regulation of Artificial Intelligence models, software, or algorithms used by intermediaries or platforms. The measures include the requirement for explicit government permission for the use of under-testing or unreliable AI models and algorithms and the need for clear user information about the potential fallibility or unreliability of the output generated. All concerned intermediaries are required to comply immediately and report to the Ministry within 15 days of this advisory.
