Announced Procon-SP Investigation into Uber's Pricing Policy with regard to dynamic pricing

On 23 February 2024, Procon-SP, the consumer protection authority of the Brazilian state of São Paulo, announced an investigation into Uber Brasil's pricing policy. The investigation focuses on the company's pricing strategy during periods of high demand, such as when public transport services are disrupted, and the way in which the parameters of its dynamic pricing are applied. Uber has been asked to provide clarification on these parameters and the tools and algorithms applied, and to provide a simulation of the same route under normal conditions and with dynamic pricing. Procon-SP also seeks to understand whether consumers are adequately informed about the application of differentiated pricing, how this information is communicated, and whether there is a maximum charge limit for passengers.
