Implemented Presidential Regulation on Collaboration between Digital Platform Companies and Media Companies including content remuneration regulation

On 20 August 2024, Regulation No. 32 of 2024 on Collaboration between Digital Platform Companies and Media Companies, which includes provisions on the collaboration between digital platform companies and media companies, entered into force. The regulation defines quality journalism as work produced by journalists working in press companies based in Indonesia. This work is regularly presented in the form of text, sound, images, data, and graphics or other formats. It is guided by the Journalistic Code and the Press Law and is disseminated through print media, electronic media, and all available channels. The regulation requires that any collaboration be stated in an agreement and may take the form of a paid licence, profit sharing, sharing of aggregated news user data or other forms of cooperation. In regard to profit sharing it should be based on the economic value of the news content used by digital platform companies. According to Article 5 (f) of the regulation, digital companies are obligated to support quality journalism by collaborating with press companies. The regulation provides recommendations for resolving disputes between digital platform companies and press companies amicably. The parties may individually or jointly have recourse to out-of-court remedies such as arbitration or alternative dispute resolution. Additionally, the regulation establishes a committee to monitor and facilitate the obligations of digital platform companies.
