On 15 February 2024, the Federal Trade Commission (FTC) issued a notice of proposed rulemaking on amendments to the Trade Regulation Rule on Impersonation of Government that would prohibit the impersonation of individuals. The proposed amendment aims to extend protections of the Trade Regulation Rule on Impersonation of Government and Businesses to individuals in order to address the increased use of technologies, such as artificial intelligence (AI), which harm consumers. Further, in the proposed amendments, the liability under the Rule would be extended to entities supplying goods and services, such as providers of AI tools, if they have knowledge or reasonable awareness that these goods or services will be used in unlawful impersonations. The consultation on the proposed rule will open after the publication in the Federal Register and will remain open for 60 days.
