The draft Law on Protection and Privacy in Telecommunications and Telemedia (“TTDSG”), proposed by the German Cabinet in February 2021, was endorsed by the German Parliament and adopted by the Federal Cabinet on 20 May 2021. The Act replaces the existing provisions of the Telecommunications Act 2004 and the Telemedia Act 2007, and implements the Directive on Privacy and Electronic Communications (2002/58/EC). Besides implementing the ePrivacy and GDPR requirement to have users agree to cookie settings, the legislation includes provisions on the confidentiality of communications, location data, caller ID display and suppression, end-user directories, technical and organisational precautions, consent for storage of information in terminal equipment, and penalties.
