United States of America: Introduced Disrupt Explicit Forged Images and Non-consensual Edits Act of 2024 (DEFIANCE Act/S 3696)

On 30 January 2024, the Disrupt Explicit Forged Images and Non-Consensual Edits Act of 2024 (DEFIANCE Act/S 3696) was introduced in the Senate. The Act aims to hold accountable individuals involved in the dissemination of non-consensual, sexually explicit "deepfake" images and videos. The DEFIANCE Act proposes the establishment of a federal civil remedy for victims identifiable in a "digital forgery." This term encompasses visual depictions created using software, machine learning, artificial intelligence, or any other computer-generated or technological methods falsely appearing to be authentic, with the goal of curbing the spread of non-consensual, sexually explicit "deepfakes."
