Introduced Digital Fairness Act (S2277)

On 3 January 2024, the Digital Fairness Act (S2277) was reintroduced into the New York State Senate. The Act aims to regulate the handling of personal information in the digital age and promote fair practices. Specifically, entities that store and process personal data of more than 500 individuals would be required to issue a public notice regarding the purpose of collection and processing. The entities would be required to obtain explicit consent from individuals before collecting, transmitting, and monetising their personal data. Additionally, the Act would establish new rights for individuals concerning their data, including the right to request deletion, correction, and information regarding the transfer of data to third parties. The Act also includes enforcement mechanisms, such as civil actions and fines, to ensure compliance.
