Terminated Presidential provisional measure (no.1. 068) including amendments concerning the civil rights framework for the internet

On 14 September 2021, the Federal Supreme Court (STF), granted a precautionary measure in seven Direct Unconstitutionality Actions (ADIs) to suspend the Presidential Provisional Measure No. 1.068 to amend the Civil Rights Framework for the Internet (Law No 12.965/2014). The measure specifies that excluding content and accounts from social media platforms could only occur with fair cause and motivation. In particular, in order to delete accounts or user-published content, social media platforms would need to make a justified decision. This decision should specify the particular breached portion of the contract or terms of service, detail the post or conduct considered to be in violation, and state the legal grounds for the decision.
