Introduced Bill on Public Contracts: Artificial Intelligence Services Safety, Privacy, and Nondiscrimination Standards Act (SB 892)

On 3 January 2024, the Bill on Public Contracts: Artificial Intelligence Services Safety, Privacy, and Nondiscrimination Standards Act (SB 892) was introduced by the California Senate. The Act mandates the Department of Technology to establish safety, privacy, and nondiscrimination standards for the acquisition of artificial intelligence (AI) services. From 1 August 2025, the state will be prohibited from entering into a contract for AI services unless the provider meets these defined standards. The Department of Technology is also required to report to the Legislature regarding the established standards, ensuring nondiscriminatory policy within the algorithm of the artificial intelligence service, embedding privacy rights into the AI service, and ensuring safety mechanisms are in place regarding the AI service.
