Argentina: Introduced Law of Bases and Starting Points for the Freedom of Argentina including Anti-competitive Agreements Regulation

Description

Introduced Law of Bases and Starting Points for the Freedom of Argentina including Anti-competitive Agreements Regulation

On 27 December 2023, the Law of Bases and Starting Points for the Freedom of Argentina was introduced into the Congress of Argentina, which includes a proposal to amend the Act on the Defence of Competition. The proposed law includes regulations on anti-competitive agreements, introducing a clemency program that allows individuals or entities involved in such behaviour to report themselves and potentially benefit from exemption or reduction of fines. The Competition Agency, subject to approval by the Competition Defense Tribunal, will analyse and grant clemency applications. The law also stipulates that clemency benefits cannot be jointly applied for by multiple participants in the reported conduct.
