On 13 December 2023, Attorney General (AG) Rob Bonta filed a brief in the Ninth Circuit in defence of California’s Age-Appropriate Design Code Act. The AG aims to overturn a preliminary injunction that is blocking the Act from going into effect. The brief contains the arguments for overturning the preliminary injunction, stating that the Act is not in violation of any law and that the United States District Court for the Northern District of California had wrongly interpreted the effect of the Act. Further, the AG states that the plaintiff only challenged certain provisions in the Act and not its entirety. The Act obliges businesses to protect children’s data and prohibits certain actions that entail the collection or use of such data.
