On 12 December 2023, the Federal Court issued a ruling in the ACCC lawsuit against Fitbit regarding statements to consumers on faulty devices. Fitbit has been ordered to pay AUD 11 million in penalties for making false, misleading, or deceptive representations to 58 consumers regarding their consumer guarantee rights. The company admitted to providing incorrect information to customers about their eligibility for refunds or replacements for faulty devices. Fitbit falsely claimed that warranty periods had expired for 40 consumers and told 18 others they were not entitled to a refund unless they returned the faulty product within 45 days of purchase.
