Implemented Guangdong-Hong Kong-Macao Greater Bay Area Implementation Guidelines for the Standard Contract for Cross-border Flow of Personal Information

On 13 December 2023, the Implementation Guidelines for the Standard Contract for Cross-border Flow of Personal Information within the Guangdong-Hong Kong-Macao Greater Bay Area (GBA Standard Contract) entered into force. The Standard Contract was adopted by the Innovation, Technology and Industry Bureau (ITIB) of Hong Kong and the Cyberspace Administration of China (CAC) and aims to promote and enable the safe and orderly transfer of personal data within the GBA and is implementing the signed Memorandum of Understanding (MoU) on Promoting Cross-Border Data Flow signed by the parties. The Standard Contract can be used voluntarily and includes a pre-designed template with the processor’s and recipient’s obligations and responsibilities to ensure the protection of the personal data transferred.
