On 1 December 2023, the Jamaican Data Protection Act, 2020, entered into force. In particular, the Act establishes that consent serves as a legal foundation for the processing of personal data. The Act also outlines the rights of data subjects including the right of access, to prevent processing of personal data, rectification, and rights related to automated decision making. In addition, the Act provides that data controllers must adhere to the eight data protection standards outlined in the Act. These standards include, among others, principles such as fairness, lawfulness, purpose limitation, data minimisation, and accuracy.
