Introduced Bill to enact the Ohio Personal Privacy Act (HB 345)

On 29 November 2023, the Ohio House of Representatives introduced a Bill to enact the Ohio Personal Privacy Act (HB 345). The Bill applies to companies conducting business in Ohio or producing products or services for consumers in Ohio that satisfy at least one of the size criteria defined in the Bill. In particular, the Bill would apply to businesses that have 25 million in annual gross revenues or, process the data of more than 100’000 consumers or obtain 50% of their revenue from selling data and processing the data of more than 25’000 consumers. The Bill specifies the obligations of the controller and processor, exempts certain businesses, defines consumer rights and assigns exclusive authority for enforcement of the Bill to the Attorney General of Ohio.
