Adopted Decree No. 70/2021/ND-CP including registration requirement

On 20 July 2021 the Vietnamese government adopted decree No. 70/2021/ND-CP, amending several articles of Decree No. 181/2013/ND-CP (dated 14 November 2013), aiming to regulate online advertisement in Vietnam. Providers of cross-border advertising services with systems and equipment outside the territory of Vietnam, but targeting users in Vietnam and thus, generating income in Vietnam, are subject to the regulation. These companies have to notify the Ministry of Information and Communications ('MIC') about the organization name, contact person and the location of the main server providing the service and if any, the server system located in Vietnam. 15 days before starting the business of cross-border advertising services in Vietnam, the MIC has to be notified. The decree will be implemented on 15 September 2021.
