Issued Court of Justice ruling on case C-376/22 regarding restriction of information society services through abstract legislative measures

On 9 November 2023, the Court of Justice of the European Union issued its ruling on Case C-376/22 on the restriction of information society services through legislative measures brought before the court by Google, Meta, and TikTok against Komm Austria. The Court ruled that under Directive 2000/31 on Information Society Services, in particular electronic commerce, a Member State cannot subject a platform to “general and abstract obligations” when the platform has its main establishment in another Member State. The case was brought by Google, Meta, and TikTok, which challenged Austria's application of the Austrian federal law on communication platforms, arguing it is incompatible with Directive 2000/31.
