Introduced Bill establishing the General Data Empowerment Law providing for the Brazilian data monetization ecosystem (PLP 234/2023)

On 1 November 2023, the Bill establishing the General Data Empowerment Law providing for the Brazilian data monetisation ecosystem (PLP 234/2023) was introduced in the Chamber of Deputies of Brazil. In particular, the Bill introduces amendments to several existing laws, such as some contained in the General Data Protection Act (LGPD), with the aim of defining terms related to data handling, privacy, and regulation in Brazil. The Bill would establish a framework allowing for the entities collecting data and the data subject to enter into an agreement, enabling the data subject to receive monetary compensation for the use of its data. The data subject would be able to monetise its non-sensitive data, behavioural data, anonymised or pseudonymised sensitive data and data related to financial transactions or commercial transactions.
