On 30 October 2023, the President of the United States signed an Executive Order (EO) on Safe, Secure, and Trustworthy Artificial Intelligence (AI), including worker monitoring regulation. The EO requires the Chairman of the Council of Economic Advisers to submit a report within 180 days on AI's effects on the labour market and the steps that the government can follow to mitigate workforce disruptions. In addition, the Secretary of Labor has to develop within 180 days principles and best practices for employers to address and mitigate AI’s potential harms and issue guidelines regarding the use of AI to monitor or augment employees’ work and the obligations that employers continue to have under the Fair Labor Standards Act.
