On 5 September 2023, the Review Board of the US Copyright Office rejected a second request to review the refusal of the Registration Program to register a two-dimensional artwork generated by an artificial intelligence (AI) system called "Théâtre D'opéra". The Board confirmed the Registration Program's decision with the explanation that the applicant did not disclaim that the material was produced by AI. Furthermore, the content generated by AI exceeds a "de minimis" part of the work. According to the Board, the applicant's sole contribution to the work was inputting text prompts into the AI tool.
