United States of America: Implemented Advanced Computing Chips Rule 2023 (AC/S IFR)

On 16 November 2023, the US Bureau of Industry and Security (BIS) Advanced Computing Chips Rule 2023 (AC/S IFR) was implemented. The BIS amended the parameters for identifying restricted chips and limited the export of chips based on the compatibility of certain parameters. The BIS also introduced a notification requirement for the export of certain additional chips with performance below the defined threshold. Furthermore, the BIS established new and extended license and notification requirements and introduced new red flags and additional due diligence provisions to prevent circumvention with applicable US export controls.
