Adopted EU Commission template on submission of a reasoned request for exemption by designated gatekeepers under Article 10 of DMA

On 9 October 2023, the European Commission adopted the template for the submission of a reasoned request to be exempted from a specific obligation outlined in Articles 5, 6 and 6 of the Digital Markets Act (DMA) based on Article 10. In particular, the gatekeepers have to indicate the legal grounds, provide justifications and specify the core platform service for which the exemption is requested. The Commission specifies in its template that an exemption can only be granted on the grounds of public health and public security, pursuant to Article 3.
