On 18 August 2023, the Securities and Exchange Commission (SEC) filed a motion with the US District Court in the Southern District of New York to certify for interlocutory appeal. The SEC argues that the interim ruling impacts other ongoing litigation and that the request is warranted due to substantial differences in opinion regarding the constitution of investment contracts. The motion concerns the court's ruling on programmatic offers of the cryptocurrency Ripple and offers on crypto exchanges. The defendant, Ripple Labs, has until 1 September 2023 to file its response.
