Adopted Bill prohibiting the distribution of AI-generated pornographic images without the individual's consent (S 01042)

On 6 June 2023, the Bill prohibiting the distribution of AI-generated pornographic images without the individual's consent (S 01042) was adopted by the New York State Assembly. The Bill substituted Assembly Bill A 3596. The Bill amends the penal law to classify the harassment facilitated by emerging technologies, including artificial intelligence tools, that can realistically superimpose someone's face onto another person's body as a criminal offence. The Bill prohibits the dissemination of intimate images and sexually explicit depictions of an individual created by technological tools without the individual explicit consent. Offenders could be sentenced to a maximum of one year in prison, and the Bill also empowers victims with the right to initiate legal action in civil Court.
