Issued ruling on civil lawsuit concerning the unauthorised use of image on Google Maps (Evany v Google Brazil)

On 24 September 2023, the Court of Justice of the State of Sao Paulo issued a ruling in a claim against Google submitted by Maria de Jesus Evany after Google Maps displayed a partial image of her face at the residence where she worked. The claimant had previously issued two requests for Google to remove her picture in order to avoid identification. The Court found that displaying the image without consent violates the claimant’s personality rights and ordered Google to pay BRL 15'000 as compensation.
