Granted certiorari for Supreme Court lawsuit challenging Florida and Texas content moderation laws arguing incompatibility with freedom of speech right (NetChoice v Florida/ NetChoice v Texas)

On 29 September 2023, the US Supreme Court announced it granted certiorari for a case challenging Florida and Texas content moderation laws (22-555, Netchoice, LLC v Paxton) for its October term 2023. Having taken into account the Solicitor General's brief, the Supreme Court will decide on the constitutionality of a Texas law restricting the ability of online platforms to engage in content moderation. In particular, two questions are approved for judgement: (1) whether the content moderation restrictions comply with the first amendment; and (2) whether the requirement for individual explanations for certain types of moderation complies with the first amendment.
