On 18 September 2023, the Banning Surveillance Advertising Act of 2023 (HR 5534) was introduced in the US House of Representatives. The Act applies to advertisers and advertising facilitators and would prohibit targeting the dissemination of an advertisement, or enabling an advertiser, advertising facilitator, or third party to do so by providing lists of individuals or connected devices, contact information, a unique identifier that may be used to identify an individual or a connected device, or providing other personal information that can be used to identify individuals or connected devices. The dissemination of an advertisement based on a recognised place associated with the individual is excluded from the ban.
