On 1 September 2023, the Healthy Technology Act 2023 was introduced into the US Congress. The Act amends the Federal Food, Drug, and Cosmetic Act by allowing artificial intelligence or machine learning technologies to qualify as a practitioner eligible to prescribe drugs. In order to qualify for the role of a prescribing practitioner, the technology must be authorised by state law and must receive approval, clearance, or authorisation under specific federal regulations governing medical devices and products.
