Closed consultation on draft to partially amend the Enforcement Regulations of the Act on the Protection of Personal Information

On 13 October 2023, the Japanese Personal Information Protection Committee (PIPC) closed its consultation on the draft to partially amend the Enforcement Regulations of the Act on the Protection of Personal Information. The draft aims to amend certain provisions of the Enforcement Regulations in response to recent incidents of personal information leaks, including the delineation of circumstances under which interference with the rights and interests of individuals, as defined in Article 7 of the Act, is considered substantial. These circumstances primarily pertain to instances involving the inappropriate acquisition or attempted acquisition of personal information. In particular, the revised draft outlines the reporting obligations imposed on entities engaged in the handling of personal information which will be required to submit reports to the PIPC when they become aware of situations that constitute an improper acquisition of personal information.
