Germany: Issued DSK application notes on the adequacy decision on the EU-US Data Privacy Framework

On 4 September 2023, the German Data Protection Conference (DSK) issued its application notes on the adequacy decision on the EU-US Data Privacy Framework. The application notes aim to explain the European Commission's new Adequacy Decision concerning the EU-US Data Privacy Framework. They are addressed to data controllers, processors, and affected individuals in Germany involved in transmitting personal data to the USA. The notes cover the scope of the regulation, alternative data transfer mechanisms, and the rights of affected individuals when dealing with entities in the USA. Furthermore, the application notes stress the need for a thorough assessment of the US legal framework and practices, called a Transfer Impact Assessment (TIA), when using mechanisms like Standard Data Protection Clauses (SCCs) for data transfers to the USA.
