Switzerland: Supreme court issues judgment allowing legal challenges against removal of comments by SRG

On 29 November 2022, the Swiss federal supreme court (Bundesgericht) ruled that the deletion of a comment on an editorial post by the national radio and television company (Schweizerische Radio- und Fernsehgesellschaft (SRG)) on one of their online forums or social media channels can be legally challenged. Whether, in a specific case, an impermissible infringement on the freedom of expression of the author is present or not should be examined by the independent authority for radio and television (Unabhängige Beschwerdeinstanz für Radio und Fernsehen (UBI)) following mediation by the SRG Ombudsman's Office.
