India: Filed ruling in civil lawsuit regarding online advertising practices (DRS Logistics Ltd. et al. v. Google LLC)

On 10 August 2023, the High Court of Delhi issued a verdict in the civil lawsuit against Google concerning its online advertising practices. This legal action had been brought forward by DRS Logistics Ltd and others. The Delhi High Court determined that Google's Ads program falls within the scope of the country's Trademarks Act, requiring the company to remove ads that infringe upon trademarks. The court observed that Google actively participated in using the trademarks of proprietors. The case was initiated based on a complaint from the logistics firm DRS, which alleged that searches for its trademark "Agarwal Packers and Movers" displayed competitor websites. DRS claimed that Google's advertising mechanism exploited its trademark to redirect users to rival sites. The court directed Google to address DRS's concerns and remove the offending ads.
