Amended General Regulation and provisions for digital asset service provider (DASPs)

On 10 August 2023, the Autorité des marchés financiers (AMF) amended its General Regulation and policy concerning the regime for digital asset service providers (DASPs) in response to the "enhanced" registration introduced by the DDADUE Law. These changes, set to take effect from 1 January 2024, are also designed to proactively anticipate the transition to the European Regulation on markets in crypto-assets (MiCA) by aligning the provisions for licensed DASPs. The main aims are to incorporate the provisions applicable to DASPs subject to "enhanced" registration into the General Regulation and its policy, harmonise the requirements for DASPs licences with those for European authorisation for crypto-asset service providers (CASPs) under the MiCA Regulation, and enable the implementation of a fast track procedure for CASP authorisation.
