Adopted Regulation 20/2016 Regarding the Protection of Personal Data in an Electronic System including cross-border data transfer regulation

On 7 November 2016, Indonesia's Minister of Communications and Informatics adopted Regulation 20/2016 Regarding the Protection of Personal Data in an Electronic System, which includes cross-border data transfer regulation. The Regulation implements parts of Government Regulation 82/2012. Regulation 20/2016 requires operators undertaking cross-border data transfers to coordinate with the Ministry by providing an implementation plan that, among other things, names the purpose of the transfer, as well as an implementation report on the result of the transfer. The Regulation will enter into force on the date of its official promulgation.
