On 9 January 2021, the Indonesian Competition Authority published a Study on Business Actors and Market Structure in the Digital Economy. The Study aims to examine the market structure of the e-commerce sector in Indonesia, set out possibilities to defining relevant markets, and examine possible anti-competitive acts in the sector. The KPPU sets out a number of regulatory priorities and recommendations, including using computer-based methods to detect potential anti-competitive acts by platforms using algorithmic pricing strategies. The KPPU also recommends the enactment of regulations giving government agencies access to business data and the establishment by the Personal Data Protection Bill of supervisory powers relating to market abuses stemming from misuse of user data. Finally, the KPPU suggests that all electronic agreements by platforms should be subject to review by the National Consumer Protection Agency to prevent the proliferation of standard contracts that are harmful to consumers.
