Implemented Kominfo Regulation No. 5 of 2020 on Private Electronic System Operators including business registration requirement (Regulation 5/2020)

On 24 November 2020, Kominfo Regulation No. 5 of 2020 on Private Electronic System Operators (ESOs), which includes content moderation regulation, was implemented. Regulation 5/2020 is an implementing regulation of Regulation 71/2019. Regulation 5/2020 states that private ESOs are obliged to register with the Ministry 6 months after the Indonesian Online Single Submission system becomes effective (date to be determined). Particularly, ESO must provide a translated deed of establishment and obtain legal approval from the Indonesian consulate. Moreover, the operators must comply with current regulations by interrupting the hosting of unlawful content and providing access to electronic systems for the purposes of criminal law enforcement.
